Federal Skilled Worker Express Entry

Skilled workers are people who are chosen as permanent residents based on their ability to prosper in Canada. A Federal skilled worker (FSW) application is based on the factors set out below before the Express Entry process.

Basic FSW Eligibility

The Federal Skilled Worker applicant must meet these requirements:

  • at least one year of continuous and paid (full-time or an equal amount in part-time) work experience
    • in a single occupation,
    • within the last 10 years,
    • at skill type 0, or skill levels A or B of the current edition of the Canadian National Occupational Classification (NOC)

Arranged employment

A valid job offer has to be for permanent, full-time and not seasonal work in a NOC 0, A or B occupation.

Depending on the case, there are different factors that make a job offer valid.

  1. Applicant currently works in Canada on a temporary work permit, and:
  2. Applicant currently working in Canada in a job that is exempt from the LMIA requirement under:
  • an international agreement (such as, the North America Free Trade Agreement)

OR

  • a federal-provincial agreement.

Also:

  • their current employer has made a permanent job offer based on their being accepted as a skilled worker.
  • their work permit must be valid both when they apply and when the visa is issued (or they are authorized to work in Canada when their visa is issued), and

 

3) Applicant currently:

  • does not have a work permit, or
  • does not plan to work in Canada before you get a permanent resident visa.

OR

  • is working in Canada and a different employer has offered them a permanent full-time job,

OR

  • is  working in Canada in a job that is exempt from a Labour Market Impact Assessment, but not under an international or federal-provincial agreement, and an employer has made them a permanent job offer based on their you being accepted as a skilled worker,

AND

The employer has a positive Labour Market Impact Assessment from Employment and

 Social Development Canada (ESDC).

Minimum Requirements

Work Experience

If the application is eligible to be processed, IRCC will then assess it to see if the work experience is valid. The work experience must be:

  • at least one the year of 1560 hours (30hrs/week), full-time or an equal amount in part-time,
  • paid work (volunteer work, unpaid internships, etc. do not count),
  • in the same occupation, and
  • within the last 10 years,
  • at skill type 0, or skill levels A or B of the current edition of the Canadian National Occupational Classification (NOC)

Language Ability

The applicant must meet minimum language levels and include the results of a language test from an agency approved by IRCC when they apply. This should demonstrate that they meet the minimum language requirement of Canadian Language Benchmark (CLB) 7.

Education

The applicant must have:

  • a Canadian diploma, certificate, or credential

    AND/OR

Six Selection Factors

If all the conditions set out in Sections A and B above are met and have the applicant has

the minimum 67 pass mark or higher, maximum of 100 points

on the six selection factors listed below they may proceed in creating on online profile under the Express Entry online system.

  • skills in English and/or French, Canada’s two official languages,
  • education,
  • work experience,
  •  age,
  • arranged employment in Canada, and
  • adaptability (how well you are likely to settle here).

Proof of Funds

Applicant will need to show proof to the Canadian visa office in their home country that they have enough money when they apply to immigrate.

The amount of money needed to support a family is set by the size of the family. Note: the required funds are updated each year on the IRCC website.  Refer to this link for the  updated amounts.

Proof of funds is not required if:

  • the applicant has a valid offer of arranged employment in Canada AND
  • the applicant is currently working or authorized to work in Canada.

Inadmissibility

Some people are inadmissible—they are not allowed to come to Canada. Several things can make the applicant inadmissible, such as being involved in criminal activity, in human rights violations or in organized crime. The applicant can also be inadmissible for security, health or financial reasons. See IRPA sections 34 to 42.

An assessment is required before inadmissible persons can apply under an immigration program.

Express Entry

Following changes are implemented recently:

You can get additional points for good French skills

If you score NCLC 7 or higher on all four French language skills (listening, speaking, reading and writing), you will get

  • 25 additional points if you scored CLB 4 or lower in English (or you have not had an English test); or
  • 50 additional points if you scored CLB 5 or higher on all four English skills

This is in addition to points you get for official languages.
